Compensatory Services, Now what?

Lately as families continue to see the repercussions of the Covid-19 closures and the impact on learning it had on their students, many of our school districts are granting Compensatory Services to families in hopes of recoup educational loss or discrepancies of being out of compliance of a child's IEP. Essential this is when a special education student is deprived of FAPE, a school district fails to identify a child with a disability, as well as failure to develop an appropriate IEP.

But how does this works and how do you as the parent make sure the county holds true to their word and delivers these services to your child? First of all your child has to qualify for Comp Ed. Is there significant documented evidence of denial of FAPE for this student?  If so, you want to meet with your local education agency to discuss. The amount of Comp Ed is determined by

  1. Attendance
  2. Documentation,  IEEs, Evaluations
  3. Documentation of services delivered
  4. How far behind is the child
  5. How long will it take to "close the gap"
  6. What services will be needed for the child to catch up

Remember this would be additional minutes, services to your child NOT already written in the IEP. It is also NOT EYS (Extended School Year) It is also NOT to replace what the child is already receiving. In terms of how and when this recouping of minutes and services are delivered, you must keep the lines of communication open with the school systems and collaboratively create a schedule for your child.  Please remember, just because you are awarded Compensatory Services doesn't mean it will happen. Unfortunately you the parent must do your due diligence and stay on top of this!
